Administrative regulations for the approval of mining gold minerals

   In order to strengthen the management of mineral mining gold, the protection of national mineral resources, effective implementation of the "People's Republic of China Mineral Resources Law" and the relevant provisions of the "Administrative Measures on Registration of Mineral Resources Exploitation," the National Development and formulated the "gold handle Reform Commission approved mineral mining Book Management Regulations, from January 1, 2004 Implemented.

Article 1 In order to strengthen the management of mining gold minerals and protect the interests of national mineral exploitation, according to Article 17 of the Law of the People's Republic of China on Mineral Resources and the Administrative Measures for the Registration of Mineral Resources Exploitation (State Council Order No. 241 ) It is stipulated that these regulations be formulated.
Article 2 The mining of gold minerals shall be subject to the examination and approval of the National Development and Reform Commission (hereinafter referred to as the National Development and Reform Commission) and the approval of the mining gold minerals issued by the National Development and Reform Commission before exploitation.
Article 3 Applicants for mining gold minerals shall fill in the “Application for Mining Gold Minerals” and submit the following materials:
(1) Application documents for mining gold minerals;
(2) Clearly indicating the regular map of the mining area;
(3) Construction of the review and verification documents of the geological reserves report or the approval documents of the geological reserves report;
(4) The environmental impact assessment report of the project approved by the environmental protection department;
(5) When there is a dispute in the mining industry that has been applied for, it shall be accompanied by a mining agreement signed by the relevant department;
(6) Where gold mining is to be carried out in the form of shareholding, the company's contract, articles of association and documents approved by the relevant departments shall be provided.
Article 4 If the National Development and Reform Commission examines the relevant materials submitted by the applicant for mining gold minerals, if the application materials are incomplete or do not meet the relevant requirements, the applicant shall inform the applicant of all the contents that need not be corrected on the spot or within 5 days.
Article 5 If the applicant's application materials are complete and meet the relevant requirements, the National Development and Reform Commission shall, within 20 days from the date of accepting the application, make a decision on whether to approve the applicant's mining of gold minerals. If a decision cannot be made within 20 days, it may be extended for 10 days upon approval by the person in charge of the administrative organ, and the applicant shall be informed of the reasons for the extension.
Article 6 The validity period of the "Approval of Mining Gold Minerals" shall be determined according to the following mine scale:
(1) If the ore is treated for more than 500 tons per day, the period of validity is 15 years;
(2) The daily processing of ore 100-500 tons is valid for 10 years;
(3) If the ore is processed below 100 tons per day, the validity period is 5 years;
If it is necessary to continue mining after the expiration of the period of validity, it shall be applied for the continuation of mining procedures in time before the expiration of 30 days.
Article 7 When the gold resources of mining are exhausted, the relevant enterprises shall go through the formalities for cancellation of the National Development and Reform Commission and return the "Approval of Mining Gold Minerals".
Article 8 The "Application for Mining Gold Minerals" and the "Approval for Mining Gold Minerals" shall be uniformly printed by the National Development and Reform Commission, and it is strictly forbidden to forge, rent, lend or transfer.
Article 9 These regulations shall be interpreted by the National Development and Reform Commission.
Article 10 These Provisions January 1, 2004 Since its implementation, the Notice of the former State Economic and Trade Commission on Printing and Distributing (Regulations on the Approval of Mining Gold Minerals) (Guo Trading Gold [2000] No. 161 ) shall be abolished at the same time.
